The holdback can only be released after a 55-day lien period has passed from the date of substantial completion. Substantial completion is formally established when a Certificate of Substantial Performance is published in the BC Gazette (your contractor is responsible for this step on larger projects). On smaller residential additions, the practical trigger is the date all major work is finished and final inspections are passed. Once 55 days have elapsed with no liens filed against your property, you can safely release the holdback. If a lien is filed during that window, do not release the holdback — consult a lawyer immediately.
What Should Be Complete Before Final Payment
Before releasing any final payment beyond the statutory holdback, confirm the following are in order:
All municipal inspections must be passed and a final occupancy approval or inspection sign-off received. In Vancouver and across Metro Vancouver municipalities, this includes framing, insulation, electrical (inspected by Technical Safety BC), plumbing, and a final building inspection. Do not release final payment if the building permit is still open with outstanding inspection items.
All deficiencies must be corrected. Walk through the completed addition with your contractor and create a written deficiency list before final payment. Common deficiencies include paint touch-ups, trim gaps, caulking at exterior penetrations, hardware adjustments, and incomplete tile grout. A reasonable contractor will address these before expecting final payment — a problematic one will pressure you to pay first and fix later. Pay first and fix later is a situation you want to avoid entirely.
All documentation should be in your hands. This includes the final building permit sign-off, warranty documents for materials and workmanship, appliance manuals, paint colours and product codes, and any engineer's letters or as-built drawings. For laneway houses and suites, you'll also need the occupancy approval from the municipality.
Practical Payment Structure
Most Metro Vancouver addition contracts are structured with progress draws — typically a deposit (10-15%), then draws at foundation completion, framing completion, rough-in completion, and drywall completion, with the final payment (often 10-15% of the contract) held until substantial completion. The statutory 10% holdback applies across all draws, not just the final one.
Never pay the full contract amount before the lien period expires. Even if you trust your contractor completely, subcontractors and suppliers they haven't paid can file liens against your property — and you could end up paying twice.
