In-Law Suites

In-law suites — self-contained living units within or attached to a single-family home — address one of Metro Vancouver's most pressing housing needs: providing independent living space for aging parents, adult children, or family members who need proximity without sacrificing privacy.

British Columbia's secondary suite regulations, updated significantly in recent years to encourage gentle densification, provide a clear legal framework for building in-law suites that comply with BC Building Code and municipal zoning bylaws. The provincial government's 2023 legislation requiring municipalities to allow secondary suites in all single-family zones has removed many of the zoning barriers that previously prevented in-law suite construction in parts of Metro Vancouver.

A legal in-law suite in BC requires a full kitchen (sink, stove, refrigerator, and counter space), a bathroom with toilet, sink, and shower or bathtub, a sleeping area that meets minimum room dimensions, a separate entrance (which can be shared with the main dwelling through a common vestibule but must provide independent access to the exterior), and fire separation between the suite and the main dwelling.

BC Building Code specifies fire separation requirements including fire-rated drywall assemblies, self-closing fire-rated doors at any connection between the suite and the main house, interconnected smoke alarms, and in some cases a fire sprinkler system depending on the age and configuration of the building. Sound insulation between the suite and main dwelling — while not always required by code — is strongly recommended for livability and is a common upgrade.

The most practical locations for in-law suites in Metro Vancouver homes include basement conversions (the most common approach, leveraging existing below-grade space), above-garage suites (utilizing the space above a detached or attached garage), ground-level additions extending the home's footprint, and conversions of existing ground-floor rooms. Each location presents different challenges.

Basement suites in older Kitsilano and East Vancouver homes often require underpinning for ceiling height, egress windows for bedrooms, and significant moisture management. Above-garage suites in Burnaby and Surrey require structural assessment of the garage to support residential loads, plus fire separation between the garage and the suite. Ground-level additions in Richmond and Delta must account for high water tables and floodplain requirements.

Parking requirements add complexity — most Metro Vancouver municipalities require one additional off-street parking space for a secondary suite. The suite must have its own address for emergency services, and the homeowner must obtain a secondary suite permit and register the suite with the municipality.
